In order to sell your unwanted items on Buymygadgets you will be asked to accept and agree to the following Terms & Conditions by ticking the box marked "Tick to Accept Terms & Conditions" to affirm that you have read, accept and agree to be bound by these Terms and Conditions when completing your transaction and selling your items. If you do not accept and agree to be bound by these Terms and Conditions you will be unable to sell your items on Buymygadgets.
Please ensure that you have carefully and thoroughly read these Terms and Conditions before selling your items on Buymygadgets. We also recommend that you retain a copy of these Terms and Conditions for your records


The contract between you and Buymygadgets is formed when you complete your transaction on Buymygadgets, by way of submitting your order to us. You will receive a “thank you for completing your order" email from us as a confirmation that you have completed a transaction. You may not transfer, assign, charge or in any way dispose of this contract or any of your rights or obligations arising under it, without our express written prior consent, which may be electronically communication by way of email. We may transfer, assign, charge, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract at our discretion. Buymygadgets is for the use of UK and Channel Island Residents Only. You are the legal owner or have permission of the owner to sell the items through Buymygadgets. You are at least 18 years old; or if you are under 18 years of age, that you have obtained your parent’s or guardian’s consent to sell your items to us for the sum indicated on our website and you and your parents/guardians release us/Buymygadgets of any liabilities or claims that may arise if you send your items to us in breach of this warranty. Once we have received your items, checked them and dispatched payment for them to you, then ownership of the items passes immediately and irrevocably to us. Wherever and whenever in this contract the term/phrase or wording/words “cancel the contract" exists this expressly and only refers to your rights to exercise a “cooling-off period" for the sale of gadget products.

Selling your Gadget Products:

Each gadget product that you sell to us should match the make and model and condition that you describe it on our website when selling your gadget products on Buymygadgets. When we quality assess your gadget product we will use the Condition Specifications given below, which were presented to you on our website when you described the condition of the item to make sure that the gadget product you sent to us is as you described it on our website. The Condition you described the gadget product to be in when selling your gadget product to us on our website directly affects the price we offer for it and if we determine the condition to be different from that which you described we may offer you a revised valuation. Details of what happens when we offer a revised valuation are contained within these Terms and Conditions.

Very Good

·         No scratches or cosmetic damage, no cracks, or damage to screen

·         Not be water-damaged (water indicators must not be red)

Condition 2

·         Fully functional and complete with working system software

·         Item may have minor scratches, marks or scuffs blemishes

·         No cracks or damage to screen

·         All buttons work

·         All features work e.g. Making calls, touchscreen, Wi-Fi, camera, video etc

·         Complete with back cover and battery

·         Not be water-damaged (water indicators must not be red)

Condition 3

·         Fully functional and complete with working system software

·         No cracks or damage to screen

·         Item has heavy wear and tear / scratches

·         All buttons work

·         All features work e.g. Making calls, touchscreen, Wi-Fi, camera, video etc

·         Complete with back cover and battery

·         Not be water-damaged (water indicators must not be red)


Water or liquid damaged in any way
Missing parts / all parts heavily damaged
Item broken in two / bent
IMEI Blocked

Please be aware that WE DO NOT ACCEPT gadget products that are in FAULTY condition, by this we mean any and all gadget products which meet any of the condition specifications for Faulty above. Please DO NOT send us any ‘FAULTY" gadget products.

All phones and devices must not be activation locked and must be deregistered from any associated accounts. All phones and devices must be on a UK network. Phones or devices locked to a foreign network will not be accepted.

By submitting an order through our site you warrant that the phone(s) or device(s) comply with these terms.

If your gadget product(s) fail(s) our quality assessment process we will contact you via email and inform you of the new valuation we have determined for the gadget you have sent us. In this email you will be provided with the option of accepting the revised valuation or declining it. Please note that Buymygadgets valuation of the item is final and no discussions will be entered into regarding the value we place on the item once it has been through our quality assessment process.

You will be provided with 7 days to accept or decline the revised valuation we have provided to you on email. If you take no action and do not respond to this revised valuation email correctly within the 7 day period then we will automatically process payment for the gadget product(s) at the revised valuation price we have sent to you.

We recommend that you delete ALL any personal information (“Data") that is or maybe stored on your gadget product/device such as, but not limited to, digital images/pictures, contact information, usernames, passwords, internet browsing history, settings, songs, mp3s, videos, games. You hereby agree to release and indemnify Buymygadgets from all and any losses, claims or damages with respect to the gadget product/device, data stored or contained therein or on any media storage device or media that has, maybe, is used in conjunction with the devices including, but not limited to, SIM or SD cards. We accept no responsibility whatsoever in relation to the data that you may, whether knowingly or unknowingly, have provided, whether personal, confidential, private otherwise your own or on the gadget product because of action taken whilst it was in your possession, to us when selling your gadget products and furthermore we take absolutely no responsibility for the security of such or any data that reaches us as a result of the sale of your gadget products. You accept that it is entirely your own responsibility to remove such data from the gadget product prior to sending it to us.

We take no responsibility whatsoever and you are fully responsible for cancelling any contracts linked to the gadget product(s)/device(s) that you sell to us including, but not limited to, airtime contracts, call or data charges arising before or after we have received your gadget product or that may arise anytime, or under any circumstances whatsoever.

Please be sure to remove any and all SIM, media storage / memory cards from your gadget products prior to sending them to us. If we discover on receipt/reviewing your gadget product(s) that storage devices, SIM Cards, memory cards or similar devices have been sent to us we will NOT return them, they will be recycled/disposed of responsibly and we accept no liability for these items sent in error by you and furthermore we will not be liable and you agree to indemnify us completely for any charges incurred as a result..

You may cancel the contract with us at any time up to the time when you send us the gadget(s) ("cooling-off period"), providing:.

When cancelling during the cooling-off period, you need not give us any reason for cancelling the contract, nor will you have to pay any administration charges.

By sending your gadget(s), you agree that we may begin work immediately in order to deal with your gadget(s) sale, which may affect cancellation rights and that once you send a gadget(s) to us, your cooling off rights will no longer apply.

We will however return your gadget(s) if, when we receive it, we find that it has a lesser value than originally stated such that we revise the value and you confirm that you do not wish to sell your gadget(s).

To cancel the contract you must notify us in writing before the end of the “cooling-off period" and preferably by emailing cooledoff@buymygadgets.co.uk and placing your order ID in the subject line of the email.

If you inform us during the cooling-off period that you no longer wish to send your gadget(s), we will remove your sales order from our system so that we know you will not be sending your gadget(s) and so that you are removed from our reminder system. In those circumstances, you will not be entitled to any payment from us whatsoever.

Revised Payments & Returns

If we deem that the condition of the gadget differs from the condition that was described or if a gadget fails to meet our terms and conditions we may propose an adjusted price by email. If you choose not to accept the revised offer, then we’ll usually return the gadget free of charge. We will however ask for a return postage payment of £5.90 or more depending on postage costs when an item fails to meet our terms and conditions and we are unable to offer any amount for it, or if a revised offer has been declined and the price was revised for one of the following reasons:

When an item was described as fully working but found to have a fault.

·         The item has an activated liquid indicator

·         Where an item has visible damage that was not described, such as a cracked screen or casing.

·         Where an item has been blocked by one or more mobile operators.

·         Where an item is locked with a passcode.

·         Where an item is received with all major parts not intact, for example if the housing is received in two parts.

In the unlikely event that a returned item is lost in the postal system then we will offer compensation up to the amount of our revised offer. Items are returned via Royal Mail recorded delivery and we retain all postage receipts as evidence of return.

Unclaimed Items

All items received in the post that do not contain any order information will be retained for a period of 60 days from the date of receipt, after which time they will be sold. During this 60 day period a seller can lay claim to such an item by providing us with a description of the packaging used and any other distinguishable features of the parcel and or item.

Lost or Stolen Mobile Phones and Devices

Selling a mobile phone or device which you do not own may amount to a criminal offence. Buymygadgets support and adhere to the ‘Stop Stolen Mobiles Being Recycled’ code of practice set by the Home Office and the National Mobile Phone Crime Unit.

We will check the IMEI/Serial number of all mobile phones and devices received on the CheckMEND (www.checkmend.com) database of lost and stolen property records to ensure no lost or stolen items are purchased.

If a mobile phone or device is found to have a record that indicates it has been lost or stolen or we become aware of any other issue relating to its ownership, we will notify the seller by email and quarantine the mobile phone or device for an initial period of 28 days (“the Quarantine Period”). Payment for the mobile phone or device will be withheld by us until the CheckMEND record does not show the mobile phone as stolen or lost.

In such circumstances you will be required to contact CheckMEND to prove that you are the rightful owner of the mobile phone or device and have the lost or stolen records associated with it cleared within the Quarantine Period and/or resolve any other issue relating to its ownership.

If during the Quarantine Period the mobile phone or device is cleared on the CheckMEND database and any other issue relating to ownership of the same is resolved, your sale will be processed and paid for as normal.

However, where the mobile phone or device is not cleared on CheckMEND within the Quarantine Period, we will be required by law to hold onto the mobile phone or device, pass it to the Police or other law enforcement body or dispose of it, and by entering into this contract, you expressly agree to this action. You will not receive any payment if such steps are taken.

UK legislation states that we cannot under any circumstances return or pay for a mobile phone or device which is lost or stolen or recorded as such.

If you have received payment from us for a mobile phone or device which we subsequently become aware of an issue relating to ownership, you agree to immediately reimburse us in full, within 3 business days following a written request by us, for any such payment pending an investigation by us or any law enforcement body into ownership of the device or mobile phone.

If we at any time become aware of any issues relating to the ownership of the mobile phone or device, you agree to co-operate with us fully with a view to resolving the issues. You may also be contacted by the Police and/or other law enforcement authorities.

We may disclose seller details to the Police or other authorised bodies (such as, but not limited to, network operators and insurance companies) for the purpose of investigating or preventing a crime. By entering into this contract you agree to us supplying data to the police or other authorised bodies for the purpose of the prevention and detection of crime, arrest and prosecution of offenders or for the recovery of stolen property.


Prices offered on our website are subject to change at any time without notice.

All prices include VAT (or other applicable tax).

When your order has been placed, the prices quoted are guaranteed for 14 days from the 'Order Approved' date. (This is the date on which we send you a confirmation letter and Freepost bag.) If your phones are received after 14 days from the 'Order Approved' date, the up-dated, current prices will apply. This could be disappointing - so to help you, we'll send a reminder email during the 14 day guarantee period.

Postage & Packaging

It remains the seller’s responsibility to ensure that our address details are accurately written on the package used for postage. We do not accept responsibility for non-delivery of gadgets or damage in transit. We therefore recommend that for items with a value of less than £41, sellers use registered post. We further recommend that sellers use special delivery for items with a value of over £41. We also recommend that customers obtain proof of postage from a post office.

All parcels must be secured properly and appropriate packaging should be used.

Bank Transfer & PayPal payments

During the checkout process you will be asked for your bank or paypal details to receive payment. We assume no responsibility whatsoever for the validity of the details that you provide and it is your sole responsibility at all times to ensure the payment details provided on the website are correct.

Under no circumstances will payment be dispatched prior to receiving and processing your gadget(s).

When we receive your order, we will check that it is complete, and that it meets our terms and conditions. Providing it does, we will transfer payment to the relevant bank or PayPal account within 24 hours. Please allow up to 48 working hours for your handset to be checked in during busy periods including bank holidays, weekends and events outside of our control.

Bank Transfer and paypal payments can only be made to the account details or email address given when placing the online order. We cannot, under any circumstances, recall or reissue bank transfer or paypal payments once they have been made.

All quoted payment timescales above are subject to variances during busy periods and buymygadgets.co.uk will not be liable for any losses that you may incur if for any reason we fail to make payment in the aforementioned timescales.

Please Note: Payment can only be made using the details given during the checkout process.

Events Outside Of Our Control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control or due to our compliance with any applicable laws or regulations.
