In order to sell your unwanted items on Buymygadgets.co.uk you will be asked to accept and agree to the following Terms & Conditions by ticking the box marked "Tick to Accept Terms & Conditions" to affirm that you have read, accept and agree to be bound by these Terms and Conditions when completing your transaction and selling your items. If you do not accept and agree to be bound by these Terms and Conditions you will be unable to sell your items on Buymygadgets.co.uk
Please ensure that you have carefully and thoroughly read these Terms and Conditions before selling your items on Buymygadgets. We also recommend that you retain a copy of these Terms and Conditions for your records.
The contract between you and Buymygadgets.co.uk is formed when you complete your transaction on Buymygadgets.co.uk, by way of submitting your order to us. You will receive a “thank you for completing your order" email from us as a confirmation that you have completed a transaction.
You may not transfer, assign, charge or in any way dispose of this contract or any of your rights or obligations arising under it, without our express written prior consent, which may be electronically communication by way of email.
We may transfer, assign, charge, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract at our discretion.
Buymygadgets.co.uk is for the use of UK and Channel Island Residents Only.
You are the legal owner or have permission of the owner to sell the items through Buymygadgets.co.uk.
You are at least 18 years old; or if you are under 18 years of age, that you have obtained
your parent’s or guardian’s consent to sell your items to us for the sum indicated on our website and you and your parents/guardians release us/Buymygadgets.co.uk of any liabilities or claims that may arise if you send your items to us in breach of this warranty.
Once we have received your items, checked them and dispatched payment for them to you, then ownership of the items passes immediately and irrevocably to us.
Wherever and whenever in this contract the term/phrase or wording/words “cancel the contract" exists this expressly and only refers to your rights to exercise a “cooling-off period" for the sale of technology (tech) products.
Valuations of Technology Products
When selling your items payment is made based on the value offered at the time of transaction only and your technology product being of the condition when we review the quality of the technology product (tech product) that you have described, by way of selecting a condition for the item, having read and understood the specifics of the condition that you have described it as, which are clearly provided to you, when you are selling technology items on Buymygadgets.co.uk
Selling your Technology (Tech) Products:
All tech products sold to us are checked by our quality control team during the quality assessment process. If your tech product fails our quality assessment it will be because the item that you have sent to us is NOT as you have described it when entering the detail of this item onto our website (Buymygadgets.co.uk) and therefore the information you have provided during the selling process to us does not match that gathered by our quality control team when reviewing the tech product(s) that you have sent to us.
Each tech product that you sell to us should match the make and model and condition that you describe it on our website when selling your tech products on Buymygadgets.co.uk. When we quality assess your tech product we will use the Condition Specifications given below, which were presented to you on our website when you described the condition of the item to make sure that the tech product you sent to us is as you described it on our website. The Condition you described the tech product to be in when selling your tech product to us on our website directly affects the price we offer for it and if we determine the condition to be different from that which you described we may offer you a revised valuation. Details of what happens when we offer a revised valuation are contained within these Terms and Conditions.

Please be aware that WE DO NOT ACCEPT tech products that are in FAULTY condition, by this we mean any and all tech products which meet any of the condition specifications for Faulty above. Please DO NOT send us any ‘FAULTY" tech products.
All phones and devices must be on a UK network or not locked. Phones or devices locked to a foreign network will not be accepted.
By submitting an order through our site you warrant that the phone(s) comply with these terms.
If your tech product(s) fail(s) our quality assessment process we will contact you via email and inform you of the new valuation we have determined for the item you have sent us. In this email you will be provided with the option of accepting the revised valuation or declining it. Please note that Buymygadgets.co.uk valuation of the item is final and no discussions will be entered into regarding the value we place on the item once it has been through our quality assessment process.
You will be provided with 4 days to accept or decline the revised valuation we have provided to you on email. If you take no action and do not respond to this revised valuation email correctly within the 4 day period (4 day period will begin from 9:00hrs on the day the email is sent to you and end 96 hours later) then we will automatically process payment for the tech product(s) at the revised valuation price we have sent to you.
You may choose to cancel the contract for the sale of your TECH Products during the “cooling-off period" provided that:
The contract was concluded (and negotiated) exclusively by means/way of “distance communication (including but not limited to telephone, email or letter) and you are acting outside the purposes of any business.
To cancel the contract for TECH Products you must inform us in writing before the end of the “cooling-off period" and preferably by emailing email@example.com and placing your order ID in the subject line of the email. We will arrange for the Tech Product(s) that you have chosen to have returned to you, as a result of your written confirmation to us, to be returned to you and no administration charges will be applied.
If you accept the revised valuation, the new price agreed between you and Buymygadgets.co.uk for the item will be updated in the relevant order, we will present this information to you in the “my account" section of Buymygadgets.co.uk and when processing your payment for the relevant order this revised valuation will be the new price paid for that specific tech item. The revised valuation is the last and only price we will offer for the tech product.
If you choose to decline the revised valuation offered, within the “Cooling-off Period" you must inform us in writing before the end of the “cooling-off period" and preferably by emailing firstname.lastname@example.org and placing your order ID in the subject line of the email. We will arrange for the Tech Product(s) that you have chosen to have returned as a result of your written confirmation to us, to be returned to you and no administration charges will be applied.
If you choose to decline the revised valuation offered, outside of the “Cooling-off Period" and have not accepted the revised valuation offered on email and the 4 days acceptance period for the revised valuation has passed then your items have automatically been processed at the revised valuation, will not be returned and you will be paid the revised valuation for the tech product. The tech product(s) cannot be returned to you in this instance.
We recommend that you delete ALL any personal information (“Data") that is or maybe stored on your tech product/device such as, but not limited to, digital images/pictures, contact information, usernames, passwords, internet browsing history, settings, songs, mp3s, videos, games. You hereby agree to release and indemnify Buymygadgets.co.uk from all and any losses, claims or damages with respect to the tech product/device, data stored or contained therein or on any media storage device or media that has, maybe, is used in conjunction with the devices including, but not limited to, SIM or SD cards. We accept no responsibility whatsoever in relation to the data that you may, whether knowingly or unknowingly, have provided, whether personal, confidential, private otherwise your own or on the tech product because of action taken whilst it was in your possession, to us when selling your tech products and furthermore we take absolutely no responsibility for the security of such or any data that reaches us as a result of the sale of your tech products. You accept that it is entirely your own responsibility to remove such data from the tech product prior to sending it to us.
We take no responsibility whatsoever and you are fully responsible for cancelling any contracts linked to the tech product(s)/device(s) that you sell to us including, but not limited to, airtime contracts, call or data charges arising before or after we have received your tech product or that may arise anytime, or under any circumstances whatsoever.
Please be sure to remove any and all SIM, media storage / memory cards from your tech products prior to sending them to us. If we discover on receipt/reviewing your tech product(s) that storage devices, SIM Cards, memory cards or similar devices have been sent to us we will NOT return them, they will be recycled/disposed of responsibly and we accept no liability for these items sent in error by you and furthermore we will not be liable and you agree to indemnify us completely for any charges incurred as a result.
Registered Stolen or Lost Tech Products
We will check the status of all mobile phones/devices received against the National CheckMEND database (using the unique IMEI number). If your mobile phone/device is found to have a red flag by CheckMEND, it must be quarantined for 28 days whilst its status is reviewed. The mobile phone/device will have a red flag if it has been registered as lost, stolen or barred/blocked on the CheckMEND database.
If you are advised that your mobile phone/device has a red flag against it you will need to contact CheckMEND in order to review the status of your mobile phone/device. You will be advised of the procedure required by email from us.
The purpose of the quarantine period is to allow the rightful owner the opportunity to have the red flag removed in order that the mobile phone/device can be processed appropriately.
If, during the quarantine period the red flag is removed, your mobile phone/device will be processed and paid for as normal and will not be returned. However, if after the quarantine period has expired and the red flag has not been removed then we are required by law to dispose of it and you will not receive any payment.
UK legislation states that we cannot under any circumstances return the mobile phone/device during this 28 day period unless the red flag has been removed.
If we become aware of any issues you will be required to co-operate with the authorities and we reserve the right to withhold or cancel the payment.
Both parties shall only be liable under this contract for losses, which are a directly attributable to the relevant breach of contract and liability shall not exceed the amount of the Offer for either party. We will not be liable, in contract, tort (including, without limitation, negligence), pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise out of or in connection with the conditions for:
Any special indirect, punitive, incidental, special or consequential damages relating to your Contract with us. This includes but is not limited to direct and indirect loss of profit and loss of income.
While we will use reasonable endeavours to verify the accuracy of any information we place on the website, we make no warranties, whether express or implied in relation to its accuracy. The website is provided on an “as is” and “as available” basis without any representation or endorsement made and we make no warranties of any kind, whether express or implied, in relation to the website, or any transaction that may be conducted on or through the website including but not limited to, implied warranties of non-infringement, compatibility, security, accuracy, conditions of completeness, or any implied warranty arising from course of dealing or usage or trade.
We make no warranty that the website will meet your requirements or will be uninterrupted, timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy and reliability of the website. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to trade goods to us on our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you trade.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

We are not responsible for the content, accuracy or opinions express in such websites, and such websites are not investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked web site on or through the Site or the Service does not imply approval or endorsement of the linked website by us. If you decide to leave the Site and access these third-party sites, you do so at your own risk.
No warranty or guarantee is given as to the time taken to complete the transaction. Buymygadgets.co.uk will make reasonable endeavours to complete the process in a fair timescale.

Please note that it is the responsibility of the user to ensure that payment details and addresses that are provided are accurate. If as a result of incorrect payment data the payment is made to the wrong party and the money cannot be recovered then the loss is the responsibility of the user. Under such circumstances if payment funds are recovered buymygadgets.co.uk reserve the right to make a reasonable administration charge.
Changes to Legal Notices
We reserve the right to change these terms and conditions from time to time and you should look through them each time you make a new offer.
Buymygadgets takes no responsibility for damage or loss for items sent to us by Royal Mail or any other courier you use. Customers are recommended to get proof of postage from the Post Office.
Law, Jurisdiction and Language
This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
Third Party Rights
Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
